Mexico Steel Wire Rod: Prelim AD Circumvention Det for 1 Co
The International Trade Administration has issued an affirmative preliminary determination that carbon and certain alloy steel wire rod with an actual diameter between 4.75 mm and 5.00 mm produced in Mexico and exported to the U.S. by Deacero S.A. de C.V. is circumventing the antidumping duty order on carbon and certain alloy steel wire rod from Mexico (A-201-830) by means of a minor alteration, and will be subject to duties.

(In its initiation notice, the ITA noted that wire rod with an actual diameter that is less than 5.00 mm is not within the scope of the subject AD duty order; however, the order does not specifically exclude wire rod with an actual diameter between 4.75 mm and 5.00 mm. The ITA now determines that the 0.25 mm difference between the wire rod products at issue and subject wire rod do not alter the expectations of the ultimate users, the use of the merchandise, and the channels of marketing in any meaningful way. As a result, shipments of wire rod with an actual diameter between 4.75mm and 5.00 mm by Deacero constitute merchandise altered in form or appearance in such minor respects that it should be included within the scope of the order on wire rod from Mexico.)
Liquidation Suspended on Deacero Entries on/after June 8
The ITA will direct U.S. Customs and Border Protection to suspend liquidation on wire rod with an actual diameter between 4.75 mm and 5.00 mm produced and/or exported by Deacero with a time of entry on or after June 8, 2011 (the publication date of the initiation of the inquiry).
“All Others” Cash Deposit of 20.11% Required for Deacero on/after June 8
The ITA will also instruct CBP to require a cash deposit equal to the “all others” rate of 20.11% for each unliquidated entry of wire rod with an actual diameter between 4.75 mm and 5.0 mm produced and/or exported by Deacero with a time of entry on/after June 8, 2011.
