ITC Votes to Institute Patent Investigation Against Nanya SemiConductor Chips w/DRAM Circuits

The International Trade Commission has voted to institute a patent investigation of certain semiconductor chips with DRAM circuitry and modules and products containing same (337-TA-819). The products at issue in this investigation are DRAM semiconductor devices.

The investigation is based on a complaint filed by Elpida Memory, Inc., of Japan and Elpida Memory (USA) of Sunnyvale, CA, on November 15, 2011. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain semiconductor chips with DRAM circuitry and modules and products containing same that infringe patents asserted by the complainants. The complainants request that the USITC issue an exclusion order and cease and desist orders.

The ITC has identified the following as respondents in this investigation:

  • Nanya Technology Corporation of Taiwan; and
  • Nanya Technology Corporation, U.S.A., of Santa Clara, CA.
