Inkjet Ink Supplies and Parts: Possible 337 Exclusion for 4 Firms

The International Trade Commission is considering whether to grant the request of Hewlett-Packard Company and Hewlett-Packard Development Company, LP to issue a general order to exclude certain inket ink supplies and components (337-TA-730) from entry into the U.S. and/or issue one or more cease and desist orders, due to patent infringement in the importation and sale of such articles.

Comments and proposed remedial orders are due to the ITC by September 14, 2011, with reply submissions due by September 21.

If ITC Issues Order, USTR has 60 Days to Approve or Disapprove

If the ITC orders some form of remedy, the U.S. Trade Representative, as delegated by the President, has 60 days to approve or disapprove the Commission’s action.

During this period, the subject articles would be entitled to enter the U.S. under bond, in an amount determined by the Commission and prescribed by the Secretary of the Treasury. The Commission is therefore interested in receiving submissions concerning the amount of the bond that should be imposed if a remedy is ordered.

Four Respondents Could be Subject to Such Orders

The ITC states that four respondents could be subject to such orders, as all the other respondents have been terminated from the investigation based on consent orders. The four possible affected parties are:

  • Shanghai Angel Printer Supplies Co., Ltd. of Shanghai, China (‘‘Shanghai Angel’’);
  • Zhuhai National Resources & Jingjie Imaging Products Co., Ltd. of Guangdong, China (‘‘Zhuhai National’’);
  • Tatrix International of Guangdong, China (‘‘Tatrix’’); and
  • Ourway Image Co. Ltd. of Guangdong, China (‘‘Ourway’’)
