ITC Institutes Patent Enforcement Proceeding on DC-DC Controllers

The International Trade Commission has instituted a formal enforcement proceeding relating to its patent investigation into certain DC-DC controllers and products containing the same (337-TA-698) that was instituted in December 2009 based on a complaint filed by Richtek Technology Corp. of Taiwan and Richtek USA, Inc. of California.

In August 2010, consent orders were issued that prohibited the importing, offering for sale, and selling for importation of DC-DC controllers, or products containing the same, into the U.S. that infringe the asserted patents or that contain or use the asserted trade secrets. On July 21, 2011, Richtek filed a complaint for enforcement proceedings, asserting that two respondents, uPI Semiconductor Corp. of Taiwan and Sapphire Technology Limited of Hong Kong, violated the consent orders.

Therefore, the ITC has determined to institute formal enforcement proceedings to determine whether either or both of the two respondents are in violation of the August 2010 consent orders, and what, if any, enforcement measures are appropriate.
