China Tissue Paper: ITA Finds Vietnam Firm Circumventing AD Order
The International Trade Administration has issued a final determination that certain tissue paper products produced by Max Fortune (Vietnam) Paper Products Company, Limited (MFVN) and exported to the U.S. are made from jumbo rolls and/or cut sheets of tissue paper produced in China, and are circumventing the antidumping duty order on tissue paper from China (A-570-894).

ITA Finds Finished Product Conversion is Minor, Value of Process is in China
The ITA has made a final determination that the process of converting the jumbo rolls and/or cut sheets of tissue paper into the finished tissue paper products in Vietnam is minor or insignificant, and that the value of the jumbo rolls and/or cut sheets produced in China is a significant portion of the total value of the finished tissue paper products MFVN exported to the U.S.
Suspension of Liq Continues on Entries Produced by MFVN on/After Mar 29, 2010
The ITA will direct U.S. Customs and Border Protection to continue to suspend liquidation on all unliquidated entries of tissue paper produced by MFVN with a time of entry on or after March 29, 2010, irrespective of the exporter1.
Cash Deposit Required for Entries Produced by MFVN at Exporter Rate
The ITA will direct U.S. Customs and Border Protection to require cash deposits of estimated AD duties, at the rate applicable to the exporter1, on all unliquidated entries of tissue paper produced by MFVN with a time of entry on or after March 29, 2010.
ITA to Consider Changed Circumstances in Future Admin Reviews for MFVN
The ITA states that if it conducts an administrative review in the future and determines in the context of that review that MFVN has not produced for export tissue paper using Chinese origin jumbo rolls and/or cut sheets, the ITA will consider initiating a changed circumstances review to determine if the continued suspension of all tissue paper produced by MFVN is warranted.
1In the preliminary determination, the ITA stated that it would direct CBP to suspend liquidation and require cash deposits at the China-wide entity rate of 112.64% on all unliquidated entries of tissue paper produced by MFVN “and/or exported by MFVN” with a time of entry on or after March 29, 2010. However, for its final determination, the ITA is concerned only with merchandise produced by MFVN, irrespective of the exporter.
