ITA Final Rule Updates Regs for AD/CV Electronic Filing and Documents
The International Trade Administration has issued a final rule amending its regulations to require the electronic submission of all documents and data in antidumping duty and countervailing duty proceedings. Under the rule, all AD/CV documents and data, with certain exceptions,1 must be submitted to ITA electronically using IA ACCESS and following the procedures set out in the IA ACCESS Handbook.

Effective for AD/CV Proceedings Active or Initiated on/after Aug 5
The effective date of this final rule is August 5, 2011, and it will apply to all AD/CV proceedings that are active on or initiated on or after this date.
Mostly Affects Lawyers, Importers May Be More Interested in Future Phases
ITA sources state that the final rule, which represents the first phase of a three-phase plan to make ITA’s AD/CV proceedings more electronic, mostly affects legal counsel as they generally file documents on behalf of interested parties in AD/CV duty proceedings. However, if an importer or other party were to submit their AD/CV documents and data directly, they would need to comply.
According to the sources, importers and the domestic industry may be more interested in the next two phases. In these phases, ITA plans to release via IA ACCESS (i) public documents it generates regarding specific AD/CV proceedings; and (ii) public versions of ITA-generated business proprietary documents. This information would be available to individuals with a registered identification and password. The sources explain that this information could be useful to an importer that may import from the same exporter involved in a separate AD/CV proceeding or to see ITA correspondence on issues of interest to them.
ITA states that each of these phases will be preceded by a pilot program designed to test and evaluate the functionality of that release.
