ACE PSCs Expected in Spring, Filing Considered "Customs Business"
During recent trade events1, U.S. Customs and Border Protection officials discussed ACE Post Summary Correction functionality, including its expected spring 2011 deployment, its plan to only review certain PSC transmissions, and the ability of a filer other than the entry summary filer to submit PSCs. The act of filing a PSC will constitute “Customs business” as defined in 19 CFR Part 111.

(PSC functionality will allow a filer to make corrections to ACE entry summary data presented to and accepted by CBP. PSCs will be able to be filed up to 270 calendar days from the date of entry, but not less than 21 days prior to liquidation. Trade participants will be able to submit a PSC for an existing ACE consumption (entry type 01) and ACE AD/CVD (entry type 03) entry summary. The PSC will be a full replacement summary. Changes related to admissibility issues, including other government agency requirements, will not be allowable via PSC.
There are no limitations to the number of PSCs that can be submitted for any one ACE entry summary as long as the PSC is within the permitted time frame and all other requirements are met. A text explanation and at least one PSC reason code will be required for each PSC submission. All entry summaries including PSCs may be subject to team review.)
PSC to Replace PEAs for ACE Entry Summaries, PEAs Will Continue for ACS Entry Summaries
Deployment of PSC functionality is still expected in spring 2011. PSCs will replace post-entry amendments (PEAs) for all ACE entry summaries -- allowing filers to send changes as they are discovered, as long as they are within the permitted time frame (up to 270 calendar days from the date of entry, but not less than 21 days prior to liquidation). PEAs will continue to be used for ACS entry summaries.
(Very few entries/entry summaries are filed using ACE; ACS is used for most entries/entry summaries. However, CBP is trying to transition the trade into using ACE to file its entries, etc.)
CBP Will Not Review Every PSC, Only Those Not Passing Edits/Validations
Each PSC will be a full ACE entry summary replacement. With PSC functionality, filers will transmit a new entry summary version with any corrections made, along with the PSC indicator. If the PSC transmission passes through all edits and validations, CBP will accept that version of the entry summary as the current correct version. However, if the PSC transmission “hits” with a CBP rule (edit, validation, or targeting), CBP would review that transmission.
With PSCs, CBP will not be using the “agree/disagree” process. CBP will not review every PSC (CBP currently looks at every correction submitted using PEAs). CBP will retain entry summary versions.
Filing PSCs is “Customs Business,” Does Not Need Entry Summary Filer
An ACE entry summary filer may submit a PSC for an ACE entry summary originally submitted by another ACE entry summary filer if authorized by the same importer of record. The act of filing a PSC will constitute “Customs business” as defined in 19 CFR Part 111.
If the PSC is filed by someone other than the entry filer, then the PSC filer will be able to run an ABI query and view information on the PSC that was filed. The entry filer will receive a UC message when a PSC has been filed by another ACE entry summary filer. The entry filer will also be able to run an ACE ABI Entry Summary Query and view limited information on the PSC (such as entry filing code, entry number, version number, the accept date and time, the PSC indicator, liquidation date, etc.).
PSC Filers Will be Able to Request Accelerated Liquidation
A filer will be able to request for CBP to liquidate the PSC using the two week liquidation cycle in order to generate a refund or bill using an “Accelerated Liquidation Request Indicator.”
Revised ACE ABI CATAIR Chapters to Include New Search Criteria, Data Elements
The revised Entry Summary Query, ACE ABI CATAIR chapter will include new search criteria for:
- PSCs
- Liquidated entry summaries
- Entry summaries that have not been liquidated
- Documents requested, yet not acknowledged and/or received by CBP
The revised Entry Summary Create/Update ACE ABI CATAIR chapter will include new data elements and input records for:
- PSC Indicator
- Accelerated Liquidation Request indicator
- PSC Header and Line Reason Codes
- Version number on outbound response (i.e. AX)
The revised Entry Summary Status Notification ACE ABI CATAIR chapter will include:
- PSC Notification Reason Code when PSC is presented by another filer
