Korea and Mexico Refrigerator-Freezers: ITC Institutes Prelim AD/CV Injury Investigations
The International Trade Commission has announced the institution of antidumping and countervailing duty injury investigations regarding bottom mount combination refrigerator-freezers from Korea and Mexico that are provided for in HTS subheadings 8418.10.00, 8418.21.00, 8418.99.40, and 8418.99.80.

These investigations are being instituted in response to a petition filed by Whirlpool Corporation, Benton Harbor, MI.
ITC to Determine if U.S. Industry is Injured
The ITC is instituting these investigations to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports of bottom mount combination refrigerator-freezers from Korea and Mexico that are alleged to be sold in the U.S. at less than fair value and alleged to be subsidized by the Government of Korea.
ITC Must Reach Preliminary Injury Determination by May 16
Unless the International Trade Administration extends the time for initiation, the ITC must reach a preliminary determination in AD and CV duty injury investigations in 45 days or, in this case, by May 16, 2011. The ITC's views are due at the ITA within five business days thereafter, or by May 23, 2010.
ITA to Initiate AD/CV Investigations if ITC Injury Found
If the ITC preliminarily finds injury, the ITA will initiate its investigation to determine whether there is dumping or subsidizing, and if so, the margin of dumping or amount of subsidy.
