CV Suspension of Liquidation, Cash Deposit Not Resumed Unless Order Issued

CBP field offices have been instructed to discontinue the suspension of liquidation for CV duty purposes on all shipments of aluminum extrusions from China with a time of entry on or after January 6, 2011 (which is 120 days after the date of publication of the preliminary CV duty determination). According to ITA sources, when the suspension of liquidation is discontinued, the CV cash deposit/bond requirement is also discontinued.

This suspension of liquidation will not be resumed, and CV duty cash deposits will not be collected, unless and until the ITA publishes a CV duty order in this case. (Any resumption would not be retroactive, and the resulting ‘gap period’ would not be liable for CV duties.)

In addition, CBP states that field offices are to continue to suspend liquidation for CV duty purposes on all shipments with a time of entry during the period September 7, 2010 through January 5, 2011, until the conclusion of the CV duty investigation.

AD Suspension of Liquidation, AD Cash Deposits/Bonds Unaffected

The discontinuation of the CV suspension of liquidation and cash deposit/bond requirements in this investigation do not affect the requirements of a cash deposit or bond on entries subject to the suspension of liquidation announced in the ITA's preliminary determination in the companion antidumping duty investigation of aluminum extrusions from China.
