1. CBP Experiencing Network Problems Affecting ACE/FAST Manifests
2. Reminder: Kinder Chocolate Eggs Banned from Import into U.S.
CBP has issued a news release reminding importers and the traveling public that Kinder Chocolate Eggs are banned from import into the U.S. Kinder Chocolate Eggs are prohibited because a toy surprise hidden inside poses a choking and aspiration hazard in children younger than three years of age.
The Kinder eggs are hollow milk chocolate eggs about the size of a large hen's egg, and are usually packaged in a colorful foil wrapper. The toy within the egg is contained in an oval-shaped plastic capsule, and has small parts that require assembly. Each egg contains a different toy.
The Food and Drug Administration has in place an Import Alert (34-02) regarding the detention without physical examination of confectionary products containing non-nutritive components. The alert states that districts may detain without physical examination all Kinder Surprise Eggs from all countries and all manufacturers/shippers. 3. Weekly TRQ/TPL Commodity Report as of December 14th
CBP has issued its weekly tariff rate quota (TRQ) and tariff preference level (TPL) commodity report as of December 14, 2009. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, OFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, OFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (Weekly commodity report, posted 12/14/09, available at http://www.cbp.gov/linkhandler/cgov/trade/trade_programs/textiles_and_quotas/commodity/cr12142009.ctt/cr12142009.pdf)
4. Updated TRQ/TPL "Threshold to Fill" List
CBP has posted an updated version of its TRQ/TPL "threshold to fill" list, a quick reference to monitor TRQs and TPLs that are approaching the restraint limit or have filled the in-quota (low) rate. The list is divided into two sections - those that are at least 85% filled and those that are closed. 5. Updated CF 1400, CF 1401 Reports
CBP has posted an updated version of its CF 1400 (Record of Vessel in Foreign Trade Entrances) - an electronic query report for CF 1400 of the Vessel Management System (VMS), in accordance with 19 CFR 4.95, organized by entrances. CBP has also posted an updated CF 1401 (Record of Vessel in Foreign Trade Clearances) - an electronic query report for CF 1401 of the VMS, in accordance with 19 CFR 4.95, organized by clearances.
