CBP has issued a CSMS message stating that on July 17, 2009, CBP published CBP Dec. 09&8722;26 titled "Guidelines for the Assessment and Cancellation of Claims for Liquidated Damages for Failure to Comply with the Vessel Stow Plan, Container Status Message, and Importer Security Filing Requirements." CBP has posted a summary of changes to the Automated Export System Trade Interface Requirements (AESTIR), indicating that Version 1.0 was changed as follows:

3. Certain Cotton TRQs to Open August 1st
CBP issued July 24, 2009 memos announcing the August 1, 2009 opening (for the quota period of 08/01/09 - 07/31/10) of the following Uruguay Rounds/GATT tariff rate quotas:
Harsh or rough cotton, not carded or combed, the product of any country or area including the U.S., and described in HTS Chapter 52, Additional U.S. Note 6 with an in-quota (low-duty) restraint level of 1,400,000 kg (QBT-09-533)
Cotton, not carded or combed, the product of any country or area including the U.S., and described in HTS Chapter 52, Additional U.S. Note 7 with an in-quota restraint level of 11,500,000 kg (QBT-09-534)
Cotton, not carded or combed, the product of any country or area including the U.S., and described in HTS Chapter 52, Additional U.S. Note 8 with an in-quota restraint level of 40,100,000 kg (QBT-09-535)
CBP states that articles that are the product of Mexico shall not be permitted or included in the aforementioned TRQs and no such articles shall be classified therein.
In addition, articles that are the product of countries or areas who are not members of the World Trade Organization (WTO) shall not be permitted or included in these TRQs.
4. Weekly TRQ/TPL Commodity Report as of July 27th
CBP has issued its weekly tariff rate quota (TRQ) and tariff preference level (TPL) commodity report as of July 27, 2009. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, OFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, OFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (Weekly commodity report, dated 07/27/09, available at http://www.cbp.gov/linkhandler/cgov/trade/trade_programs/textiles_and_quotas/commodity/cr07272009.ctt/cr07272009.pdf)
5. Updated TRQ/TPL "Threshold to Fill" List
CBP has posted an updated version of its TRQ/TPL "threshold to fill" list, a quick reference to monitor TRQs and TPLs that are approaching the restraint limit or have filled the in-quota (low) rate. The list is divided into two sections - those that are at least 85% filled and those that are closed. 6. Updated Running ACE Reports User Guide for Trucks
CBP has issued updated detailed instructions for truck carriers on running ACE reports. The Running ACE Reports User Guide includes such topics as: running a standard report, running a modified report and creating a customized report. The User Guide also includes a list of all ACE reports for truck carriers. 7. Updated CF 1400, CF 1401 Posted
CBP has posted an updated version of its CF 1400 (Record of Vessel in Foreign Trade Entrances) - an electronic query report for CF 1400 of the Vessel Management System (VMS), in accordance with 19 CFR 4.95, organized by entrances. CBP has also posted an updated CF 1401 (Record of Vessel in Foreign Trade Clearances) - an electronic query report for CF 1401 of the VMS, in accordance with 19 CFR 4.95, organized by clearances. 8. Updated Public ACS FIRMS Report
CBP has posted an updated version of its Public Automated Commercial System FIRMS (Facilities Information and Resources Management Systems) report that is organized by port code and alphabetically by company name. 9. Southwest Border Fence Construction Progress
As of July 17, 2009, CBP has completed 331 miles of pedestrian fencing and 302 miles of vehicle fencing. Generally speaking, pedestrian fence is located in urban areas and adjacent to ports of entry, whereas vehicle fence is located in relatively unpopulated and remote areas of the border.
