CBP to End Test Giving Sureties Advance Notice in ACE of Pending Bond Insufficiencies

U.S. Customs and Border Protection has issued a CSMS message announcing that effective May 22, 2009 the Revenue Division will no longer post information about continuous bonds scheduled for insufficiency in the Automated Commercial Environment.

(Since February 3, 2009, the Revenue Division has been testing a process by which CBP posts information about continuous bonds scheduled to be rendered insufficient to the surety's Business Activity Log (BAL) in ACE. The test process was scheduled to last at least 45 days before CBP decided whether to permanently adopt it.)

Test Discontinued Due to Low 'Success Rate'

Based on an overall 'success rate' of less than 50%, the Revenue Division has decided to discontinue this test process at this time.

Under the Test Process, Trade was Given Two Weeks to Rectify Issues

Beginning on February 3, 2009, any surety with ACE portal account access was able to access the postings. The postings were made available no less than two full weeks prior to the listed bonds being rendered insufficient. This was to afford the trade the chance to proactively rectify whatever issues threatened the sufficiency of the continuous bond (whether the problem is related to returned mail, or some other issue).

Each posting to the BAL provided specific information about the underlying problem(s) impacting the bond, as well as outlined the process to correct these problems.
