CBP CSMS Messages and Web Postings

CBP has issued a CSMS message stating that on April 12, 2009, changes will be made to the ACE Portal screens (as a result of ESAR A2.2's deployment) that will create new ways for carriers to navigate through the portal. On April 26, 2009, ACE will deliver screens that will accept new Western Hemisphere Travel Initiative compliant travel document types. (CBP recently stated that it would be delivering the ACE update to accommodate additional WHTI compliant travel documents for truck drivers on April 25th. 1. Upcoming ACE Portal Changes for ESAR A2.2 and WHTI

2. CBP Posts Proration/Liquidation Instructions for Tuna/Skipjack

CBP has posted a memorandum providing proration and liquidation instructions for the 2009 in-quota (low duty) tariff rate quota quantity for tuna and skipjack (tuna), in airtight containers, not in oil, weighing with their contents not over 7 kilograms each, that is not the product of any U.S. insular possession.

CBP states that this TRQ oversubscribed at opening moment on January 2, 2009 and all entry summaries and/or warehouse withdrawals presented at 12:00 p.m. EST, or its equivalent in other time zones, on January 2, 2009 will be prorated as follows: 0.9069058 or 90.69058% of the presented quantity shall be liquidated at the low duty rate (HTS 1604.14.22/6%). The remainder shall be liquidated at the over-quota (high duty) rate (HTS 1604.14.30/12.5%).

2. Weekly TRQ/TPL Commodity Report as of April 6, 2009

CBP has issued its weekly tariff rate quota (TRQ) and tariff preference level (TPL) commodity report as of April 6, 2009. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, OFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, OFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (Weekly commodity report available at http://www.cbp.gov/xp/cgov/trade/trade_programs/textiles_and_quotas/commodity/)

3. Updated TRQ/TPL "Threshold to Fill" List

CBP has posted an updated version of its TRQ/TPL "threshold to fill" list, a quick reference to monitor TRQs and TPLs that are approaching the restraint limit or have filled the in-quota (low) rate. The list is divided into two sections - those that are at least 85% filled and those that are closed. 3. Updated CF 1400, CF 1401 Posted

CBP has posted an updated version of its CF 1400 (Record of Vessel in Foreign Trade Entrances) - an electronic query report for CF 1400 of the Vessel Management System (VMS), in accordance with 19 CFR 4.95, organized by entrances. CBP has also posted an updated CF 1401 (Record of Vessel in Foreign Trade Clearances) - an electronic query report for CF1401 of the VMS, in accordance with 19 CFR 4.95, organized by clearances. 4. Updated Public ACS FIRMS Report

CBP has posted an updated version of its Public Automated Commercial System FIRMS (Facilities Information and Resources Management Systems) report that is organized by port code and alphabetically by company name. CBP posted an updated version of its FY 2008 CDSOA Annual Disbursement Report. This report contains information on the disbursements for FY 2008 and includes case number, case name, the number CBP assigned to each certification, claimant name, dollar amount certified, allocation percentage, and dollar amount paid. 9. Counterfeit T-Shirts Seized at JFK

CBP officers at JFK Airport recently seized a shipment of counterfeit designer t-shirts with a Manufacturer's Suggested Retail Price of more than $1.4 million and a domestic value of more than $50,000.
