CBP Details ESAR A2.2 Capabilities (the Initial Entry Summary Types Release)
U.S. Customs and Border Protection has posted a presentation providing an update on ACE ESAR A2.2 (the Initial Entry Summary Types release) and A2.3.1a (the Antidumping/Countervailing Duty (AD/CVD) release) that was given at the March 3-4, 2009 Trade Support Network meeting.

(CBP recently announced that it would begin implementing ESAR A2.2 in spring 2009. CBP stated that as part of ESAR A2.2, ACE entry processing capabilities will be piloted with a limited number of voluntary trade users. CBP also recently issued a general notice announcing the three-stage entry summary processing deployment schedule for ESAR A2.2, with participation in the first two stages limited to 39 volunteers. The following are highlights of CBP's information on ESAR A2.2:
ACE Entry Summary Filing (for Types 01 and 11)
When ESAR A2.2 is deployed, ACE entry summary filing will only pertain to transmitting the data elements needed for type 01 and 11 entry summaries. CBP states that the instructions will be more robust than the existing CBP Form 7501 instructions.
The entry filing instructions will contain links to more detailed sources of information impacting summary filing. The format of the instructions will coincide with the way data is transmitted, stored, and displayed in ACE.
Importers, Brokers, Etc. Will be Able to Submit Certain Declarations via the ACE Portal
As part of A2.2 functionality, importers, brokers, carriers, and filers will be will be able to submit certain declarations (listed below), which are associated at the account level such as Importer of Record Number (IR), in ACE. Brokers or filers who would like to input declarations in ACE on behalf of importers will require access to the importer's account either as a user of the importer's account or via cross account access.
Types of declarations include:
- Affidavit of Manufacturer
- Importer Certifying Statement
- North American Free Trade Agreement (NAFTA) Certificate of Origin
- Non-reimbursement Blanket Statement (AD/CVD)
Blanket declarations. Blanket declarations can be created in ACE to support both the ACS and ACE entry summaries and can be viewed nationally by CBP.
Trade Will be Able to Respond to Certain Forms via the ACE Portal
CBP Forms 28 (Request for Information), 29 (Notice of Action) and 4647 (Notice to Mark and/or Notice to Redeliver) will be created by CBP and stored in a National Database.
CBP will have the capability to mail and post these forms to an ACE portal account. Trade portal users will be able to select their preferred method of communication via the portal (mail, portal, or both). CBP Forms 28, 29, and 4627 will be posted to the trade's Task List within the ACE portal. Brokers will continue to receive a courtesy copy of CBP Forms 28, 29 and 4647 as they do today.
ACE portal users will have the capability to interactively respond to the form and attach/upload documents in response to CBP via the portal. Importers who elect to receive copies of forms through the ACE Portal are not required to respond through the portal. Brokers or filers who would like to respond to CBP Forms 28, 29 or 4647 on behalf of importers will require access to the importer's account either as a user of the importer's account or via cross account access.
Trade Will be Able to Submit Scanned Documents via the ACE Portal
Scanning technology will be enabled, allowing for document submission, storage, and retrieval for both CBP and the trade community. CBP adds that planning is underway to allow filers to submit attachments via Electronic Data Interchange (EDI).
CBP will continue to accept paper documents. CBP will not scan paper that is received; instead, such documents will be processed and stored locally.
Four New, Two Enhanced Trade Reports to be Available in ACE
Four new trade reports will be available with the deployment of ESAR A2.2, as follows:
- AM 7002 Trade Declarations Report
- ESM 7001 Entry Summary Census Warning and Override Report
- ESM 7024 ACE Reject Report
- ESM 7025 CBP Form 28, 29, 4647 Report
The following two reports will be enhanced:
- ESM 7008 Entry Summary Line Detail Report
- ESM 7068 Entry Summary Report
(According to the presentation, the A2.3.1.a release (the Antidumping/Countervailing Duty (AD/CVD) release) is in the requirements stage and is expected to be completed by April 2009, with delivery tentatively planned for winter 2010.)
