2. 2009 U.S.-Peru TPA Agriculture TRQs Opened February 1st

CBP has posted a memorandum on the 2009 tariff rate quotas for agricultural products (including "trade surplus" sugar) described in HTS Chapter 98, Subchapter XXII, U.S. Note 28 and HTS Chapter 99, Subchapter XVII, U.S. Notes 1 through 5 with respect to the U.S.-Peru Trade Promotion Agreement.

(These TRQs have a duty-free in-quota limit. Some of these TRQs have an over-quota (high-duty) limit and/or a safeguard (high-duty rate) once that in-/over-quota limit is filled. See the applicable HTS Chapter 99 subheading for safeguard rates.)

These TRQs opened Monday, February 2, 2009 with the following limits:

CBP notes that "PE" should be used as the primary SPI. CBP adds that entry summaries must be filed non-ABI until the necessary ABI programming has been completed. 3. Correction to DR-CAFTA Agricultural TRQs Memorandum

CBP has issued a memorandum revising its previously issued memorandum on the 2009 agricultural/surplus sugar DR-CAFTA TRQs.

CBP is revising the Dominican Republic's allocated amount of sugar, sugar syrup, and sugar containing products that can be entered duty-free under the "trade surplus" sugar TRQ. CBP is changing the amount to 0 kg (from 10,600,000 kg), as the USTR determined that the Dominican Republic's sugar trade surplus is negative.

CBP is also adding a sugar, sugar goods, and sugar containing products TRQ (with a limit of 2,000 kg) for Costa Rica for 2009.

4. CBP Notice on Test Process for Bond Insufficiencies

CBP has posted a notice on the test process that was scheduled to begin on February 3, 2009 during which the Revenue Division will post information about continuous bonds scheduled to be rendered insufficient to the surety's Business Activity Log (BAL) in ACE. This test process will last at least 45 days.

(Beginning on February 3, 2009, any surety with ACE portal account access were to be able to access these postings. These postings were to be made available no less than two full weeks prior to the listed bonds being rendered insufficient. This would afford the trade the chance to proactively rectify whatever issues threaten the sufficiency of the continuous bond (whether the problem is related to returned mail, or some other issue).)

CBP's notice contains much of the same information as the previously issued CSMS message announcing the test process; however, it includes information for importers on what should be done to rectify insufficiency of the continuous bond due to a 'bad address.' 5. El Paso Seizes Marijuana in Commercial Concrete Pipe Shipment

CBP has issued a news release announcing that officers working at the El Paso port of entry recently seized 957 pounds of marijuana. The drugs were found in a commercial shipment of concrete pipes. 6. CBP Messages on AD and CV Duty Actions

The antidumping and countervailing messages CBP issues on behalf of the International Trade Administration are now only available on CBP's Web site at http://addcvd.cbp.gov. AD and CV ABI administrative messages are no longer issued.
