CBP CSMS Messages and Web Postings

CBP has issued a CSMS message stating that it fixed a problem, at approximately 11:13 a.m. EDT on January 17, 2009, with ACE regarding difficulty submitting e-Manifests via the portal. (CBP previously issued a CSMS message stating ACE was experiencing a nationwide problem impacting the trade. CBP then issued a CSMS message stating that it expected to fix the problem by 11:00 a.m. EDT on January 17th. 2. CBP Posts Its FY 2008 CDSOA Annual Report

CBP has posted its fiscal year 2008 Continued Dumping and Subsidy Offset Act (CDSOA, also known as the "Byrd Amendment") annual report. This report contains three sections:

FY 2008 Annual Disbursement Report. This report contains information on the disbursements for FY 2008 and includes case number, case name, the number CBP assigned to each certification, claimant name, dollar amount certified, allocation percentage, and dollar amount paid.

Uncollected Duties for FY 2008. This report lists the amount of uncollected duties on each case as of September 30, 2008. These amounts were subtracted from the liquidated duties on each case, as CBP cannot disburse funds that have not yet been collected. CBP states that all collections on these bills that take place in the future will be disbursed in the year in which they are received.

FY 2008 Clearing Account Balances as of October 1, 2008. This report lists the amounts contained in the Clearing Account for each case. These amounts represent duties filed with the entry and are preliminary numbers and may be refunded at liquidation to the importer of record based upon Commerce Department's final determination on the case, which may not occur during the current year. Funds do not transfer from the Clearing Account to the Special Account for CDSOA distribution until liquidation occurs. The Clearing Account does not include additional duty assessed at liquidation or reliquidation.

Port director in Blaine announces retirement. CBP has issued a news release announcing that Margaret (Peg) Fearon, CBP's area port director in Blaine, WA, announced that she will retire from public service on February 1, 2009. DHS, DOI sign agreement for mitigation of border security impact on environment. CBP has issued a news release announcing that the Department of Homeland Security recently signed a Memorandum of Agreement on with the Department of the Interior regarding environmental stewardship measures related to the construction of border security infrastructure.
