CBP CSMS Messages and Web Postings

CBP has issued its weekly tariff rate quota (TRQ) and tariff preference level (TPL) commodity report as of January 12, 2009. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (Note that CBP also recently posted a January 8, 2009 version of this report.) 1. Weekly TRQ/TPL Commodity Report as of January 12, 2009

2. Updated TRQ/TPL "Threshold to Fill" List

CBP has posted an updated version of its TRQ/TPL "threshold to fill" list, a quick reference to monitor TRQs and TPLs that are approaching the restraint limit or have filled the in-quota (low duty) rate. The list is divided into two sections - quotas that are at least 85% filled and quotas that are closed. 3. 2009 Dairy Products TRQ Partially Oversubscribed at Opening

CBP has posted a notice announcing that the 2009 TRQ for dairy products, provided for in HTS Chapter 4, Additional U.S. Note 10, which opened on January 2, 2009, partially oversubscribed at opening. According to CBP, the All Other Countries limit oversubscribed. However, the Australia and Belgium/Denmark (aggregated) minimum access quantities were not exhausted and balances remain available.

The pro rata percentage for All Other Countries is 0.893572 or 89.3572%. 4. CBP, ICE Report on FY 2008 IPR Seizure Statistics, Etc.

CBP has posted a CBP/Immigration and Customs Enforcement (ICE) report on fiscal year 2008 intellectual property rights seizure statistics.

CBP has also posted statistics for IPR seizures made by CBP and ICE for FY 2008. These statistics are on the value and number of seizures, top commodities seized, top safety and security seizures, and top trading partners IPR seizures. When available, CBP compares FY 2008 seizure statistics to 2007 statistics.

In addition, CBP issued a news release on the annual report on counterfeit goods seized. (Documents are hyperlinked.)

5. CBP Resolves Problems with EDI Messages

CBP has issued a CSMS message announcing that the ACE Support Team has resolved the issue of users receiving system lock messages when trying to file e-manifests via the ACE Secure Data Portal and that as of approximately 5:15 p.m. on January 9, 2009, users who had been attempting to submit e-Manifests via EDI should begin to receive EDI response messages. CBP also issued a CSMS message announcing that as of 12:30 p.m. on January 9, 2009, the issue restricting the flow of EDI messages to ACE was resolved and all users are now able to submit e-Manifests to CBP via EDI and the ACE Secure Data Portal. 6. Mauritania Removed from Receiving AGOA Benefits Effective Jan 1st

CBP has issued a CSMS message announcing that Mauritania has been removed from receiving African Growth and Opportunity Act (AGOA) benefits for goods entered, or withdrawn from warehouse for consumption, as of January 1, 2009. 7. Various CBP Postings and Messages

Port of Portland granted "snow days" on 12/22, 12/23. CBP has issued a CSMS message stating that the port of Portland, Oregon (Port Codes 2904 and 2910) was closed on Monday, December 22, 2008 and Tuesday, December 23, 2008 due to inclement weather. As a result CBP is extending two additional days without penalty for any late-filed summaries and payment of duties. 8. Miscellaneous CBP Messages on AD and CV Duty Actions

The antidumping and countervailing messages CBP issues on behalf of the International Trade Administration are now only available on CBP's Web site at http://addcvd.cbp.gov. AD and CV ABI administrative messages are no longer issued.
