CBP CSMS Messages and Web Postings

CBP has issued its 2008 "year end" tariff rate quota (TRQ) and tariff preference level (TPL) commodity report (as of December 31, 2008). This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (2008 commodity report, posted 01/05/09, available at http://www.cbp.gov/linkhandler/cgov/trade/trade_programs/textiles_and_quotas/commodity/yr_end_archived_com_status/cr081231.ctt/cr081231.pdf)

1. 2008 "Year End" TRQ/TPL Commodity Report

2. Updated Interest Rates for Additional Duties on Reconciliations

CBP posted an updated list of the interest rates for additional duty payments owed to Customs as a result of reconciliation. The list now states that for the period January 1 - March 31, 2009 the interest rate is 5%. CBP notes that when a reconciliation results in additional monies owed CBP, the payment must be made with interest, calculated by the filer using the rates provided in the list. 3. CBP Identifies Issue with Updating of Account Management Reports

CBP has issued a CSMS message announcing that it has identified an issue with the nightly updating of Account Management reports. Account Management reports are not returning data for some entries dated after December 30, 2008. Account Revenue reports are not impacted by this issue. CBP states that the issue is currently being addressed and every effort will be made to update the Account Management reports data as quickly as possible. When all data uploads are complete, a new message will be posted to the ACE News tab and to CSMS. 4. PMS Calendar Corrected

CBP has issued a CSMS message stating that the Periodic Monthly Statement Calendar has been corrected and now reflects the correct year, month and day. CBP previously informed the trade, via a news posting on the ACE portal, that the PMS Calendar on the Statements tab in the ACE Portal was showing the incorrect year and day of the month. 5. Fifth Tranche of Recently Increased FY 2008 Global Refined Sugar TRQ Oversubscribed

CBP has issued a memorandum announcing that the fifth (and final) tranche of the fiscal year 2008 global refined sugar tariff rate quota which was recently increased (due to the re-allocation of Mexico's portion) oversubscribed at opening. The pro rata percentage is 48.65048% or 0.4865048.

Entries or withdrawals for consumption that were presented after the opening should be rejected back to the filer. The importer has the option to distribute the prorated allocation on a given entry (i.e., more or less than the prorated amount, or none at all). The importer may also transfer the allotment to entries at another port. However, in any of these scenarios, the importer may not enter more than the total prorated amount that was properly presented at opening. 6. CBP Memo on Staged Entry for Overshipments of 2008 Exports of China Agreed Quotas

CBP has issued a memorandum regarding the recent Federal Register notice on implementing delayed, staged entry for 2008 exports from China in excess of the 2008 agreed China quota limits. CBP lists the 5% staged entry limits for China categories 332/432/632-T (plus baby socks), 332/432/632-B (plus baby socks), 347/348, and 352/652. CBP has posted a notice providing details on the 2009 C-TPAT supply chain security seminar that will be held on April 1-3, 2009 in New Orleans, LA.
