CBP CSMS Messages and Web Postings

CBP has posted a memorandum regarding the re-allocation of Mexico's portion of the recently increased fiscal year 2008 tariff rate quota for refined sugar to the global refined sugar TRQ. The re-allocation will be administered on a first-come, first-served basis, in five separate openings, beginning with an allocation of 28,278,000 kg. The first opening was on October 30, 2008. The remaining allocations will consist of 10,000,000 kg each, which CBP will announce in subsequent notices. 1. CBP Memo on Re-Allocation of Mexico's Increased FY 2008 Refined Sugar Portion to the Global Refined Sugar TRQ

2. 1st Tranche of Specialty Sugar TRQ Oversubscribed at Opening Moment

CBP has posted a notice announcing that the first tranche for the fiscal year 2009 specialty sugar tariff rate quota that opened on Thursday, October 23, 2008 oversubscribed at opening moment. The pro rata percentage is 41.62391% or 0.4162391.

Entries or withdrawals for consumption for specialty sugar presented after the opening should be returned to the broker for amendment. The importer has the option to distribute the prorated allocation on a given entry (i.e., more or less than the prorated amount, or none at all). The importer may also transfer the allotment to entries at another port. However, in any of these scenarios, the importer may not enter more than the total prorated amount that was properly presented at opening.

Note that the four other FY 2009 tranches for specialty sugar will open on November 10, 2008, January 14, 2009, May 19, 2009, and August 24, 2009. (See ITT's Online Archives or 10/24/08 news, 08102420, for BP summary announcing that the first tranche would open October 23rd.)

3. Ocean AMS Processing Delays

CBP has issued a CSMS message informing ocean AMS trade participants that CBP is experiencing a delay in processing incoming data. The system is operational, but response times may be longer than usual for trade partners to receive replies. AMS participants should not retransmit any manifests, amendments or other transactions, as this will just extend the delay.

Trade partners may continue to submit requests for Lloyd's code updates or additions via the CBP Web site mechanism, however, and those requests will be processed. 4. CATAIR Amendment 28 Posted

CBP has posted Amendment 28, dated October 2008, to the Customs and Trade Automated Interface Requirements (CATAIR) document. According to CBP, the CATAIR has been amended as follows:

Automated Invoice Interface

Record Identifier C17 (Input) - Note 2 was restored.

Automated Manifest System (AMS) Broker Download

Record Identifier 1M (Output) - Made edits in description of "Importing Conveyance Name" and "Lloyds Vessel Code" data element.

Record Identifier IB (Output) - Made edits in "Note 2".

Appendix B - Valid Codes

ISO Country Codes updated.

5. Miscellaneous CBP Messages on AD and CV Duty Actions

The antidumping and countervailing messages CBP issues on behalf of the International Trade Administration are now only available on CBP's Web site at http://addcvd.cbp.gov. AD and CV ABI administrative messages are no longer issued.
