Revised ICP on Soldering and Welding Machines and Apparatus

U.S. Customs and Border Protection has issued a revised version of its informed compliance publication entitled, What Every Member of the Trade Community Should Know About: Soldering and Welding Machines and Apparatus.

This publication was prepared by the National Commodity Specialist Division of Regulations and Rulings and provides guidance on the Harmonized Tariff Schedule (HTS) classification of soldering and welding machines and apparatus. The ICP was first published in January 2000, was revised in April 2001 and March 2004, reviewed with no changes in May 2005 and March 2006, and was most recently revised in August 2008.

The following are highlights of the substantive changes made in the updated ICP:

ICP Revised to Conform to February 3, 2007 HTS Changes

This ICP was revised to conform to the World Customs Organization-recommended and other changes that were implemented by the February 3, 2007 edition of the HTS.

As a result, the HTS numbers throughout the ICP have been updated and explanatory text of the updates has been added.

Classification Information Section Added

The revised ICP has been updated to include a section entitled "Classification Tools." This section provides information on the following classification tools: the HTS and the Harmonized Commodity Description and Coding System Explanatory Notes (ENs or Explanatory Notes).

Functional Units Subsection Updated

The "Functional Units" subsection of the "Section and Chapter Notes" Section" has been updated to revise information on subheadings affected by certain HQ rulings related to welded tube mills. The ICP now reads: HQ rulings 965198, dated May 1, 2002, 229216, dated May 21, 2002, and 965296, dated July 9, 2002, classified these welded tube mills as functional units under subheading 8462.29* (or 8462.21** if numerically-controlled) as machine tools for bending metal.

This subsection was also updated to provide updated/expanded information on certain machinery lines. It now provides information on regulations that were implemented July 3, 2006 that allow an importer of record, under certain conditions, to submit a single entry to cover multiple portions of a single entity which, due to its size or nature, arrives in the U.S. on separate conveyances. Prior to July 3, 2006, the functional unit concept could not be applied if there was more than one shipment involved.

In addition, the ICP has been updated to include minor, technical, and stylistic changes, etc.
