NHTSA Proposes to Revise Certain Fees for Registered Importers of Non-Conforming Vehicles

The National Highway Traffic Safety Administration has issued a proposed rule to revise certain fee amounts in 49 CFR Part 594 relating to the registered importer (RI) program and the importation of motor vehicles not certified as conforming to the Federal motor vehicle safety standards (FMVSS) for fiscal year 2009.

NHTSA Proposes Certain Fee Increases and Decreases, Certain Fees Unchanged

NHTSA proposes the following fees to become effective on October 1, 2008 (the beginning of FY 2009):

$14 per vehicle (from the current $13) for review and processing of each certificate of conformity submitted on and after October 1, 2008 (If a RI enters a vehicle electronically through the Automated Broker Interface, has an e-mail address to receive communications from NHTSA, and pays the fee by credit card, the reduced fee for processing the certificate would remain at $6, provided that ABI entry information is correct.);

$48 (no change) to further process incorrect information in an ABI entryor in the statement of conformity;

$760 (from the current $677) for new RI applicants;

$651 (from $570) for annual RI renewal;

$827 (no change) for inspection of vehicle, if inspection is requested by a petitioner on (1) whether the vehicle sought to be imported is substantially similar to a motor vehicle that was originally manufactured for importation into and sale in the U.S. and certified by its original manufacturer as complying with all applicable FMVSS, or (2) whether the vehicle is capable of being readily altered to meet those standards;

$10.23 per bond (from the current $9.77) for U.S. Customs and Border Protection (CBP) bond processing for each imported vehicle for which a certificate of conformity is furnished;

$198 (from the current $208) for importing a vehicle determined eligible pursuant to a petition based on its substantial similarity to a U.S. certified vehicle;

$198 (from the current $208) for importing a vehicle determined eligible pursuant to a petition based on its capability of being modified to comply with all applicable FMVSS.
