CBP CSMS Messages and Web Postings

CBP issued a news release and notice announcing that it is delaying the deployment of the ACE Rail and Sea Manifest capabilities (M1) by at least six months due to problems discovered during software testing. As a result of the schedule slip, an additional four to six month delay is projected for the early 2009 deployment of initial ACE entry summary capabilities (ESAR A2.2).

1. ACE M1 Delayed At Least 6 Months; ESAR A2.2 Delayed 4 to 6 Months

2. ACE Secure Data Portal Login Problem Fixed

CBP has issued a CSMS message stating that the problem with trade partners not being able to login to the ACE Secure Data Portal was fixed as of 7:33 pm on July 28, 2008. 3. Certain Cotton TRQs to Open August 1st

CBP issued notices announcing the August 1, 2008 opening (for the quota period of 08/01/08 - 07/31/09) of the following Uruguay Rounds/GATT tariff rate quotas:

Harsh or rough cotton, not carded or combed, the product of any country or area including the U.S., and described in HTS Chapter 52, Additional U.S. Note (AUSN) 6 with an in-quota (low-duty) restraint level of 1,400,000 kg (QBT-08-516)

Cotton, not carded or combed, the product of any country or area including the U.S., and described in HTS Chapter 52, AUSN 7 with an in-quota restraint level of 11,500,000 kg (QBT-08-517)

Cotton, not carded or combed, the product of any country or area including the U.S., and described in HTS Chapter 52, AUSN 8 with an in-quota restraint level of 40,100,000 kg (QBT-08-518)

CBP states that articles that are the product of Mexico shall not be permitted or included in the aforementioned TRQs and no such articles shall be classified therein.

In addition, articles that are the product of countries or areas who are not members of the World Trade Organization (WTO) shall not be permitted or included in these TRQs.

4. CBP Posts Summary of AESTIR Changes for July 23-24, 2008

CBP has posted a summary of changes to the Automated Export System Trade Interface Requirements (AESTIR) to its Web site, indicating that Version 1.0 was changed on July 23 and 24, 2008 as follows:

5. Weekly TRQ/TPL Commodity Report as of July 28, 2008

CBP has issued its weekly tariff rate quota and tariff preference level commodity report as of July 28, 2008. This report includes TRQs on various products such as beef, sugar, dairy products, peanuts, cotton, cocoa products, tobacco, certain BFTA, DR-CAFTA, Israel FTA, JFTA, MFTA, SFTA, UAFTA (AFTA) and UCFTA (Chile FTA) non-textile TRQs, etc. Each report also includes the AGOA, ATPDEA, BFTA, DR-CAFTA, CBTPA, Haitian HOPE, MFTA, NAFTA, SFTA, and UCFTA TPLs and TRQs for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (CBP's weekly TRQ/TPL commodity report available at http://www.cbp.gov/xp/cgov/trade/trade_programs/textiles_and_quotas/commodity/)

6. Updated TRQ/TPL "Threshold to Fill" List

CBP has posted an updated version of its TRQ/TPL "threshold to fill" list, a quick reference to monitor tariff rate quotas and tariff preference levels that are approaching the restraint limit or have filled the in-quota (low duty) rate. The list is divided into two sections - quotas that are at least 85% filled and quotas that are closed.
