CBP Updates its ACE Portal Account "Terms and Conditions" for 45-Day Inactivity Period
U.S. Customs and Border Protection has issued a General Notice announcing a change to the portal activity portion of the Terms and Conditions that must be followed for access to the Automated Commercial Environment (ACE) Secure Data Portal (ACE Portal).

Access to Portal Will Terminate if No Activity for 45 Days
The period of allowable inactivity is now 45 days (from 90 days). If 45 consecutive days elapse without an Account Owner accessing the ACE Portal, access to the Portal will be terminated.
Similarly, if 45 consecutive days elapse without a Proxy Account Owner or an Account User accessing the ACE Portal, access to the Portal will be terminated for the Proxy Account Owner or Account User.
To prevent termination, CBP has previously stated that the trade should ensure that all users sign on at least once every 45 days.
Change to 45 Day Inactivity Period Reflects Change in Security Policy
CBP state that it has made this change to meet security guidelines established by the Department of Homeland Security (DHS).
Instructions for Users if Portal Access Terminated Due to Inactivity
If ACE Portal access is terminated due to 45 days of inactivity, CBP states that access may only be restored for the Account Owner, Proxy Account Owner, or Account User by calling the Help Desk.
The Account Owner may no longer re-authorize access for the Proxy Account Owner or the Account User.
Any party seeking access to the ACE Portal will be required to accept those terms and conditions as set forth on the ACE Portal screen and in this and earlier General Notices.

(CBP states that except for the expansion of the types of Portal Accounts in ACE announced on October 18, 2007, all other provisions in the May 16, 2007 Terms and Conditions for Account Access to the ACE Portal remain unchanged and in effect.

Although this Federal Register notice, and certain CBP officials, state that this change to 45 days was recently made, earlier CBP notices, other CBP officials, and the Technology Support Center, indicate that that change was implemented in late May 2008.
