CBP Issues Proposed Rule to Amend CHB Exam Eligibility Requirements

U.S. Customs and Border Protection has issued a proposed rule to amend 19 CFR 111.13 to add three requirements that an individual must satisfy in order to take the written examination for an individual customs broker's license, as administered by CBP.

(According to 19 CFR Part 111 and CBP sources, the only current requirement for taking the customs broker exam is that the individual complete the required paperwork and pay the $200 exam fee by the provided deadline.)

Three Requirements Would be Added for Exam Applicants

CBP is proposing to amend 19 CFR 111.13(b) to require those taking the written examination to:

  1. be a citizen of the U.S. on the date of examination
  2. not be an officer or employee of the U.S. Government, and
  3. have attained the age of 21 prior to the date of examination

Would Align Exam Requirements with License Requirements

CBP states that the proposed amendments would more closely align the requirements for taking the written examination with the requirements an individual must satisfy in order to obtain a customs broker's license.

(According to 19 CFR 111.11 and 111.12, to obtain a license, an applicant must (1) achieve a passing score on the broker exam, (2) submit an Application for Customs Broker License (CBP 3124) within three years of taking and passing the written exam, fingerprints, and a License Fee of $200; (3) be 21 years of age and a U.S. citizen at the time of the filing of the license application; (4) and not be an officer or employee of the U.S. Government; and (5) etc.)
