U.S. Customs and Border Protection has posted to its Web site a notice reminding the trade that Phase 2 enforcement of mandatory e-Manifest: Truck for advance cargo information purposes at all land border ports in New Hampshire and Vermont as well as the remaining land border ports in North Dakota - St. John, Fortuna, Ambrose, Carbury, Noonan, Dunseith, Sherwood, Antler, Northgate, Westhope, and Portal, would begin on September 12, 2007.

1. CBP Reminder on Phase 2 Enforcement of Mandatory e-Manifest for VT, NH, and Certain ND Ports
According to CBP, during Phase 2, it will monitor system performance and may at any time suspend this enforcement phase based on system developments. CBP adds that CBP officers may accept the presentation of the ACE trip number as submission of the e-Manifest - this can be verified by presentation of the ACE e-Manifest cover sheet or a CBP Form 7533 with the e-Manifest information. (Note BP's Phase 2 reminder does not include information regarding the ability of Phase 2 to be suspended or information on CBP officers accepting the trip number via CBP Form 7533 as proof of submission. 2. 6th Specialty Sugar TRQ Oversubscribed at Opening Moment
U.S. Customs and Border Protection has posted a notice to its Web site announcing that the sixth specialty sugar tariff-rate quota (i.e. tranche) that opened on September 10, 2007 oversubscribed at opening moment. The pro-rata percentage is 97.68432%. For those receiving allocations, CBP states that the importer has the option to distribute the prorated allocation on a given entry, (i.e., more or less than the prorated amount, or none at all) or can transfer the allotment to entries at another port (see notice for details).

3. Various "Commercially Unavailable" Designations under DR-CAFTA
CBP has issued a memo on the determination by the Committee for the Implementation of Textile Agreements that the following fabrics cannot be supplied by the Parties to the U.S.-Dominican Republic-Central America Free Trade Agreement (DR-CAFTA) in commercial quantities in a timely manner:
certain circular knit, three-end fleece fabrics;
certain raschel knit open work crepe fabrics;
certain cotton/nylon woven fabrics; and
certain polyester/nylon woven corduroy fabrics.
As a result, such fabrics are added to the list in Annex 3.25 of the DR-CAFTA in unrestricted quantities.

CBP has recently posted the following to its Web site:
U.S., Canada now accepting FAST renewal applications. CBP has posted a news release announcing that CBP and the Canada Border Services Agency are now accepting renewal applications from participants in the Northern Border Free and Secure Trade (FAST) Commercial Driver Program whose five-year memberships are approaching expiration. DHS launches initiatives to strengthen private aircraft security. CBP has posted a link to the Department of Homeland Security's press release announcing a proposed rule to further improve aircraft security in the U.S. The proposed rule would require more detailed information about arriving and departing private aircraft and persons onboard within a timeframe necessary to assess the risks that certain flights may pose to national security.
