CBP recently issued an ABI administrative message stating that the Food and Drug Administration had increased its surveillance of toothpaste, and reminding filers of the correct FDA product codes for toothpaste, as queries of the import data transmitted by filers showed many product code errors.

1. Update on CBP's Admin Message Regarding FDA's Increased Surveillance, FDA Product Codes for Toothpaste
CBP issued a second ABI administrative message correcting a product code in its first message. A third ABI administrative message is expected to be issued to correct another product code.
The following are the correct/updated product codes, according to CBP and FDA sources:
The product code for toothpaste that does not contain fluoride is 53I[ ]-011 = "toothpaste without fluoride." The appropriate subclass must be provided when using this code.
The product code for toothpaste containing fluoride is 63R[ ][ ]06 = "toothpaste with stannous fluoride (dental caries prophylactic)." Provide the appropriate subclass and process identifier code (PIC) when using this code.
The product code for kits containing toothpaste and other dental hygiene products, such as toothbrushes, is 76N[ ]-XZ "Kit, dental hygiene." The appropriate subclass must be provided when using this code.
CBP previously stated that the use of other drug and device codes for these products should be discontinued.

2. CBP Posts Summary of AESTIR Changes for June 11, 2007
CBP has posted a summary of changes to the Automated Export System (AES) Trade Interface Requirements (AESTIR) to its Web site, indicating that Version 1.0 was changed on June 11, 2007 as follows:

CBP completes ACE installation in Minnesota. CBP has issued a notice announcing that on June 8, 2007, it completed installations of the Automated Commercial Environment in Minnesota. CBP has posted a frequently asked question document regarding the temporary air travel flexibility within the Western Hemisphere for U.S. citizens with pending passport allocations. (U.S. citizens traveling to Canada, Mexico, the Caribbean and Bermuda who have applied for but not yet received passports can temporarily enter and depart from the U.S. by air with a government-issued photo identification and Department of State official proof of application for a passport through September 30, 2007.) Agriculture specialists discover 10 wood-boring insects in shipping pallets. CBP has issued a press release announcing that CBP agriculture specialists at the Laredo port of entry so far in June have had 10 interceptions of wood-boring insects and insect larvae in marked wood packaging materials, more commonly known as pallets. The discovery of these actionable pests requires that the shipments be returned to Mexico. CBP seizes pirated DVDs, caps, etc. at Laredo border crossing. CBP has issued a press release stating that CBP officers at the Laredo port of entry seized more than 200 pirated DVD movies, CDs and commercial quantities of clothing articles during a routine examination on June 9, 2007. CBP seizes 1.5 tons of undeclared cheese, half ton of undeclared pork in Pharr. CBP has issued a press release announcing that CBP officers and agriculture specialists at the Hidalgo/Pharr port of entry seized a ton and a half of undeclared Mexican white cheese and more than 1,000 pounds of undeclared pork in a shipment referred for a routine examination on June 10, 2007.
