CBP Issues ABI System Requirements for Filing Visa Numbers for Haiti HOPE Apparel (ACS Programming is Complete)
U.S. Customs and Border Protection (CBP) has issued an administrative message to advise the trade of the Automated Broker Interface (ABI) system requirements needed to file a Haitian Hemispheric Opportunity through Partnership Encouragement Act of 2006 (HOPE Act) claim.

(The Tax Relief and Health Care Act of 2006 (Public Law (P.L.) 109-432) amended the Caribbean Basin Economic Recovery Act (CBERA) by adding the HOPE Act provision, which allows duty-free entry for certain additional products of Haiti, including certain apparel items and certain automotive wire harnesses. Then, on March 19, 2007 the President issued Proclamation 8114 which amends the Harmonized Tariff Schedule (HTS) to, among other things, implement the HOPE Act.)
Haiti HOPE Act Takes Effect on March 20 for Apparel, New Chapter 98 Tariff Numbers Require Visa Numbers
The new apparel benefits for Haiti are effective for goods entered, or withdrawn from warehouse, for consumption on or after March 20, 2007.
Visa number required for four HTS 9820 tariff numbers. The Haiti HOPE Act requires special formatted visa numbers for subject Haiti apparel, for the following new HTS tariff numbers:
- 0.61.25
- 0.61.30
- 0.62.05
- 0.62.12
HOPE visa number transmission. The Haiti HOPE Act visa number associated with the above tariff numbers will be transmitted in the entry summary record identifier 51 (input) visa number field (positions 11-19).
Value, quantity should be reported the same for the HTS 9820 tariff number as the alternate tariff numbers. CBP notes that the above-listed HTS 9820 tariff numbers will have the same reporting of the value and quantity amounts on the alternate HTS tariff number as is currently done with other HTS 9820 tariff numbers.
ACS Programming is Complete, Trade Can File Haiti HOPE Act Apparel Claims Subject to the Visa Number Requirement
CBP has subsequently issued an ABI administrative message announcing that the Automated Commercial System (ACS) has been programmed and has completed the system changes to allow the trade to begin filing apparel claims that are subject to the Haiti HOPE Act visa number requirement.
