Update on Questions & Answers from CBP's October/November ACE Exchange II Conference (Part VII)

U.S. Customs and Border Protection has posted to its Web site a document listing the questions and answers from the importer and broker session of the Automated Commercial Environment (ACE) Exchange II Conference that was held from October 30-November 2, 2006 in Tucson, Arizona.

With ESAR A2, will ACE participants be able to do SILs, CF 28's, and CF 29's?

CBP states that Supplemental Information Letters (SILs) will eventually be replaced by post summary corrections. In ESAR A2, Customs Forms (CFs) 28 and 29 will be available through the Automated Broker Interface (ABI).

Importers are responsible for the CF 28; however they do not get a copy of the CF 28, only the broker does. Will this change with ACE?

According to CBP, the electronic CF 28 will be sent to the broker; however, it will also be viewable via the ACE portal. The default will be paper copy. CBP states that an importer will be able to elect how it wants to receive the CF 28. CBP adds that in the future it will also be working on imaging via ABI.

Can an ACE participant replace the entire entry summary as it does now via ABI?

No, the full replace option via ABI will go away. However, an ACE participant can continue to bring in a paper SIL or Post Entry Amendment (PEA).

How long does an ACE participant have to do a post summary correction?

CBP states that once the merchandise is released the ACE participant can do a post summary correction. CBP adds that the participant will get 183 days and can get an extension upon request.

What should an ACE participant do until the post summary correction becomes available via the ACE portal?

CBP states that the participant will need to use its broker to file via ABI. The paper SILs/PEAs will not go away until post summary correction is available via the ACE portal.

What if an importer has a shipment two days out and it filed its entry one day out and obtained a release, and then two days after arrival, the importer notices that the broker made an error? Should the importer use post summary correction?

It depends on the process the filer used for filing the entry summary. The one step process is when the entire summary (certifying off the entry summary) is filed up front to get a release of the entry. This brings the filer into the post summary corrections process. The two step process is when the filer files an entry and then 10 days later files the entry summary. If the filer uses the one step process, once the summary has been filed and accepted, the filer must do a post summary correction.

Will the broker that filed an original entry receive something from CBP informing the broker if an importer has filed a post summary correction (since it will be able to make a post summary correction via the ACE portal)?

According to CBP, it will send notification back to the filer that the record has been altered.
