U.S. Customs and Border Protection (CBP) has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on cocoa powder as provided for in HTS Chapter 18, Additional U.S. Note (AUSN) 1 for the period October 1, 2005 through September 30, 2006.

1. 2005/2006 Cocoa Powder TRQ Opens October 3, 2005
According to CBP, this TRQ opens on October 3, 2005 at 1:00 p.m. EDT or its equivalent in other time zones, and the TRQ level for all countries1 is 2,313,000 kilograms.
1CBP states that articles that are the product of Mexico shall not be permitted or included under this TPL and no such articles shall be classifiable therein.
CBP's notice lists the related HTS Chapters 18 and 99 tariff numbers, and states that imports from Canada, Mexico, Jordan, Singapore, Chile, and Australia are not subject to HTS Chapter 99, Subchapter IV, U.S. Note 1, and should be presented as a type 02 entry using the high rate (over-quota) tariff number provided for in HTS Chapters 18 without the HTS Chapter 99 tariff number. Such entries must be reported through the quota module of ACS.

CBP Frontline News. CBP has posted the September 23, 2005 issue of its Frontline News which contains articles on the Arizona Border Control Initiative Phase II, expansion of expedited removal authority along the Southwest border, the largest port in South America joining the Container Security Initiative (CSI), Automated Commercial Environment (ACE) collections topping $1 billion since July 2004, opening of registration for 2005 CBP Trade Symposium, and CBP's deployment of assets in preparation for Hurricane Rita. CBP Officer apprehends Fedex bandit. On September 26, 2005, CBP officers at the San Ysidro Port of Entry apprehended a 40 year-old Iranian male with an outstanding warrant for numerous robberies in Southern California. The man was identified by local authorities as the "FedEx Bandit," believed to be responsible for at least 40 bank robberies. CBP Commissioner Bonner announces decision to retire. CBP Commissioner Robert Bonner has announced his decision to retire from federal service. The press release notes that Bonner will establish an effective date for his departure after conferring with the Secretary of Homeland Security.
