CBTPA Non-Underwear T-Shirt TPL to Reopen October 1, 2005; AGOA Mauritius Sublimit to End

U.S. Customs and Border Protection (CBP) and/or the Committee for the Implementation of Textile Agreements (CITA) are expected to soon issue notices announcing the October 1, 2005 - September 30, 2006 Tariff Preference Levels (TPLs) for the African Growth and Opportunity Act (AGOA), the Andean Trade Promotion and Drug Eradication Act (ATPDEA), and the U.S.-Caribbean Basin Trade Partnership Act (CBTPA).

Duty-free benefits1 exist for AGOA, ATPDEA and CBTPA apparel that is, for example, assembled in an eligible beneficiary country/s from fabrics formed in the U.S. from U.S. yarns, or from components knit-to-shape in the U.S. from U.S. and/or beneficiary country yarns, etc.

TPLs provide duty-free benefits, until the TPL fills, for certain AGOA, ATPDEA and CBTPA apparel that do not meet the preference program's fabric and/or yarn origin requirements. Once a TPL level fills, imports of subject apparel are subject to otherwise applicable tariffs.

AGOA TPL and Sublimit Continue; Mauritius Sublimit to End

The AGOA TPL (an aggregate cap) for apparel articles from regional fabric or regional or U.S. yarns, provided for in 9819.11.09, as well as its Sublimit for apparel articles from lesser developed AGOA beneficiary countries (LDBCs) regardless of the country of origin of the fabric or yarn used to make the articles, provided for in 9819.11.12, continue for the October 1, 2005 - September 30, 2006 period.

However, the temporary (one year) Sublimit which exists for Mauritius, for the October 1, 2004 - September 30, 2005 period only, expires on September 30, 2005 unless extended by legislation.

It should be noted that the AGOA TPL expires on September 30, 2015 unless extended by legislation, while its sublimit for LDBCs expires on September 30, 2007 unless extended by legislation.

ATPDEA TPL to Continue

The one ATPDEA TPL for apparel articles assembled in one or more ATPDEA beneficiary countries from regional fabrics or regional components provided for under 9821.11.25, continues for the October 1, 2005 - September 30, 2006 period.

The ATPDEA TPL is scheduled to expire on December 31, 2006 unless extended by legislation.

CBTPA TPLs to Continue, with Non-Underwear T-Shirt TPL to Reopen

The two TPLs currently provided for under the CBTPA, one for certain knit and knit-to-shape apparel under 9820.11.09, and the other for certain non-underwear T-shirts under 9820.11.12, continue for the October 1, 2005 - September 30, 2006 period.

As the TPL for certain non-underwear T-shirts filled on June 23, 2005 for the 2004/2005 period, it will reopen for duty-free treatment on October 1, 2005.

These CBTPA TPLs are scheduled to expire on September 30, 2008 unless extended by legislation.
