U.S. Customs and Border Protection (CBP) has posted to its Web site notice that the fiscal year (FY) 2006 global refined and specialty sugar "low duty" tariff rate quota (TRQ) provided for in HTS Chapter 17, Additional U.S. Note (AUSN) 5, did not fill at opening moment on September 8, 2005. (This quota would normally have opened on October 1, 2005, but opened early due to supply shortages caused by Hurricane Katrina.)

1. FY 2006 Refined Sugar TRQ Did Not Fill at Opening Moment on Sept 8th (USDA Increases TRQ Level)
In addition, CBP states that this TRQ level was increased to 75,129,000 kg. (from 7,090,000 kg.) by the USDA, which is the reason it did not fill at opening. 2. 2005/2006 Fibers of Cotton TRQ Opened September 12, 2005
CBP has posted to its Web site a notice announcing the opening of the tariff-rate quota (TRQ) on fibers of cotton as provided for in HTS Chapter 52, AUSN 10 for the period September 11, 2005 through September 10, 2006.
According to CBP, this TRQ opens on September 12, 2005. The aggregate TRQ level is 2,500 kg.
CBP's notice lists the relevant HTS Chapters 52 and 99 tariff numbers. The notice also states that articles that are the product of countries or areas that are not WTO members shall not be permitted or included in the quantitative limitations set forth in this notice. CBP further states that imports from Canada, Mexico (non-NAFTA), Jordan, Singapore, and Chile are not subject to this TRQ, and should be presented as a type 02 entry using the high rate (over-quota) tariff numbers provided for in HTS Chapter 52 without the HTS Chapter 99 tariff number. In addition, CBP states that certain NAFTA imports from Mexico are provided for elsewhere in HTS Chapter 99. 3. 2005/2006 Tobacco TRQ Opened September 13, 2005
CBP has posted to its Web site a notice announcing the opening of the TRQ on tobacco as provided for in HTS Chapter 24, AUSN 5 for the period September 13, 2005 through September 12, 2006. According to CBP, this TRQ opens on September 13, 2005.
CBP's notice lists the relevant HTS Chapter 24 tariff numbers, as well the "low duty" TRQ limits for Argentina, Brazil, Chile, European Union, Guatemala, Malawi, Philippines, Thailand, Zimbabwe, and Other Countries or Areas (excluding Canada, Israel, or Mexico). CBP adds that it requires a certificate of origin for tobacco entered under this TRQ from Argentina. CBP also reiterates in this notice most of the requirements of HTS Chapter 24, AUSN 5. 4. Weekly Quota Commodity Report as of September 12, 2005
CBP has issued its weekly quota commodity report as of September 12, 2005. This report includes tariff-rate quotas (TRQs) on various products such as beef, tuna, sugar, dairy products, peanuts, cotton, cocoa powder, tobacco, certain JFTA, NAFTA, SFTA, UAFTA and UCFTA TRQs, etc. This report also includes the AGOA, ATPDEA, CBTPA, NAFTA, SFTA, and UCFTA (CFTA) tariff preference levels (TPLs) for qualifying apparel and/or other textile articles, the TRQs on worsted wool fabrics, etc. (CBP's weekly quota commodity report, dated 09/12/05, available at http://www.cbp.gov/xp/cgov/import/textiles_and_quotas/commodity/)
5. CBP's Third Revision to its Trade Update Regarding Hurricane Katrina
CBP has posted to its Web site another revised version of its trade update regarding Hurricane Katrina, in order to reflect the following change:
