The International Trade Administration (ITA) has issued its final results of the countervailing (CV) duty administrative review of polyethylene terephthalate film, sheet, and strip from India for the period of October 22, 2001 through December 31, 2002.

According to the ITA and ITA sources, this review period covers separate time periods, one for the year 2001 (October 22, 2001 - December 31, 2001), and two time periods for the year 2002 (January 1, 2002 - February 19, 2002 as well as June 27, 2002 - December 31, 2002).
The ITA states that the net subsidy rate for the 2001 review period (20.62%) will not affect the CV cash deposit rate for subject merchandise from Polyplex; however, the net subsidy rate for 2002 (19.63%) will affect the CV cash deposit rate for the subject merchandise from Polyplex, as shown below:

Assessment Instructions for the Review Period (10/22/01 - 12/31/02)
The ITA and ITA sources state that the ITA will instruct U.S. Customs and Border Protection (CBP) to liquidate shipments of subject merchandise by Polyplex with a time of entry from October 22, 2001 through December 31, 2001 at 20.62% and for such shipments with a time of entry either from January 1, 2002 through February 19, 2002 or June 27, 2002 through December 31, 2002 at 19.63%.1
The ITA states that pursuant to 19 CFR 351.212(c), for all companies for which a review was not requested, duties must be assessed at the cash deposit rate, and cash deposits must continue to be collected, at the rate previously ordered.
Both the preliminary results and ITA sources indicate that there is no CV duty liability for the period of February 20, 2002 - June 26, 2002. However, the ITA's July 2002 CV duty order and a CBP administrative message on that order indicate that this period is from February 19, 2002 - June 30, 2002.
