Miscellaneous International Trade Notices

On June 9, 2004, the Secretary of Homeland Security testified before the Senate Judiciary Committee on progress at the Department of Homeland Security (DHS). Among other things, the Secretary testified that DHS has created several new two-way channels of communication, including the National Infrastructure Coordination Center (NICC). According to the Secretary, NICC provides a centralized mechanism for the private sector, industry representatives, individual companies, and the Information Sharing and Analysis Centers to share and receive situational information about a threat, event, or crisis. 2. AMS Final Rule on Domestic/Imported Peanut Standards

The U.S. Department of Agriculture's (USDA's) Agricultural Marketing Service (AMS) has issued a final rule, effective June 8, 2004, which adopts without change an interim final rule that changed peanut quality and handling standards for domestic and imported peanuts marketed in the U.S. (See ITT's Online Archives or 08/15/03 and 09/30/03 news, 03081522 and 03093099 6, for BP summary of the interim final rule and a subsequent correction, respectively.) 3. AMS Final Rule on Lamb Order Implementation

The USDA's Agricultural Marketing Service (AMS) has issued a final rule, effective July 7, 2004, which adopts without change its interim final rule that implemented the Lamb Promotion, Research, and Information Order, which is funded by assessments (taxes) on domestic lamb producers, lamb feeders, exporters, and seedstock producers. 4. BIS Issues Civil Penalty & 20 Year Denial of Export Privileges for EAR Violations

The Bureau of Industry and Security (BIS) has issued a notice affirming an administrative law judge's (ALJ's) recommended decision and order with respect to five alleged violations of the Export Administration Regulations (EAR) committed by Jason Liao, individually and doing business as JFD International. Among other things, BIS charged that Liao exported detector log video amplifiers from the U.S. to China without the validated export license required. As a result, BIS has assessed a civil penalty of $55,000 against Liao and has ordered, among other things, that Liao's export privileges will be denied for a period of 20 years. 5. FDA Issues Updated Questions & Answers About Trans Fat Nutrition Labeling, Etc.

On March 3, 2004, the Food and Drug Administration (FDA) issued an updated version of its document entitled, Questions and Answers about Trans Fat Nutrition Labeling. Among other things, this document contains questions and answers about the FDA's regulation on Trans Fat Labeling and information about trans fats, other types of fats and cholesterol, etc.. 9. ITA Requests Applicants for Market Development Cooperator Program

The International Trade Administration (ITA) has issued a notice requesting that eligible organizations submit proposals for the fiscal year (FY) 2004 competition for Market Development Cooperator Program (MDCP) awards. The ITA states that through MDCP cooperative agreements, it works with export multiplier organizations (e.g. trade associations, chambers of commerce etc.) to provide technical and financial assistance, which these organizations match. In connection with this competition, the ITA will hold a public meeting on June 23, 2004. Proposals must be received by the TA no later than 5 p.m. EST, July 14, 2004.
