Full ABI Edits for Prior Notice of Imported Food to be Implemented on May 13, 2004

U.S. Customs and Border Protection (CBP) and the Food and Drug Administration (FDA) have clarified/re-issued an earlier administrative message regarding the full implementation of Automated Broker Interface (ABI) edits for FDA Prior Notice (PN) of imported food.

In the reissued message, CBP states that full ABI edits for FDA PN data go into effect on May 13, 2004, as part of Phase 3 of the CBP/FDA Bioterrorism Act procedures.

FD3 (not disclaimed) & FD4 ABI Entries to be Rejected if Full PN Data Not Present

Consequently, on or after May 13, 2004, entries submitted through ABI that contain a tariff number coded FD3 (unless disclaimed) or FD4 will be rejected by ABI if they do not contain full PN data.

For Certain In-Bonds, Movement Won't be Authorized Until PN Data 'Accepted'

For in-bond types 61 (IT) and 62 (T&E), CBP states that the PN data must be filed and 'accepted' (passed all ABI edits and received a PN confirmation number) before authorization for movement is granted.

ABI Warnings Will No Longer be Generated for Missing/Incomplete PN Data

Also on and after May 13, 2004, ABI warnings will no longer be generated for missing or incomplete PN data. (This applies to transactions sent on and after May 13, 2004.)

(CBP notes that full PN data is not required for transactions whereby a PN confirmation number is obtained through CBP's independent PN transaction (WP) or FDA's PN System Interface (PNSI) and then sent in as a PNC affirmation of compliance.

In addition, PN can be disclaimed on lines flagged with an FD3, using the 'PND' affirmation, when the filer believes the goods are not subject to PN requirements.

Also, Phase 3 of the CBP/FDA Bioterrorism Act procedures runs from May 13, 2004 - August 12, 2004.)
